General Information About The Madrid Protocol

 1.    To obtain protection outside Bahrain, it is necessary to file applications in the countries concerned either individually or via the Madrid Protocol.

2.    The Madrid Protocol allows a trade mark owner to seek protection for his trade mark in several countries simultaneously by filing one application with a single office, in one language, and with one set of fees in one currency (Swiss francs).

3.    Under the Madrid Protocol, a trade mark must first be registered or applied for in the country of origin before filing for an international application.

4.    A country of origin (applying through Bahrain means Bahrain must be the country of origin of a TM) is a country that is a party to the Madrid Protocol where the applicant is a resident or national of, or has a real and effective industrial or commercial establishment.

5.    The Madrid Protocol is open to its members only.

6.    An international application must be initiated in a member country (Basic application or registration must be in the country of origin) seeking trade mark protection in other member country/countries.

7.    To apply, an applicant submits a single application to the trade mark office in his home country.  In his application, he can designate the country or countries in which he wishes to seek protection for his trade mark.

8.    An international registration lasts 10 years.  It may be renewed for further periods of 10 years by paying the prescribed fees to WIPO via the country of origin.

9.    For the first five years, the international registration remains dependent on the validity of the mark registered or applied for in the country of origin.

Filing An International Application In Bahrain:

As Bahrain is a contracting country under the Madrid Protocol, an international application may be filed with TM Office in the Industrial Property Directorate in Ministry of Industry and Commerce in Bahrain. For the list of members of the Madrid Protocol, please refer to the WIPO website. Before making an international application:

1. the applicant must have an application or a registration in Bahrain on which to base his International application (“Bahrain mark”);

2. the goods or services in the applicant’s international application must be covered by his Bahrain mark; and

3. the applicant must be a resident (in Bahrain) or national of (Bahraini), or have a real and effective industrial or commercial establishment in Bahrain (legal entity in Bahrain).

4. MM2 form should be filed.

5. 20BD is the fee that should be pay to TM office in Bahrain when applying for international Application (20 for each class).

6. All forms to the international registration of a trade mark are available at the WIPO website and the fees for such forms should be made out to WIPO.

إجراءات تسجيل العلامة التجارية في مملكة البحرين

أولاً:

يقدم طلب تسجيل علامة مباشرة إلى مكتب العلامات التجارية (للبحرينيين والمقيمين في مملكة البحرين)، أو الاستعانة بأحد مكاتب المحاماة أو وكلاء التسجيل القانونيين المتخصصين في مجال الملكية الصناعية (إلزامي لغير البحرينيين أو لغير المقيمين في مملكة البحرين) للإنابة عن مالك الحق بتقديم طلبات تسجيل علامة ومتابعة سير التسجيل للعلامة، علماً بأن تكلفة تسجيل علامة تجارية في فئة واحدة تبلغ 650ديناراً موزعة على ثلاثة دفعات:

·       100 دينار لتقديم الطلب.

·       50 دينار للنشر في النشرة الخاصة على موقع الوزارةhttp://www.moic.gov.bh/Ar/Commerce/ForeignTrade/IndustrialPropertyDirectorate/ip_newsletter/Pages/default.aspx

·       500 دينار لتسجل العلامة وإصدار شهادة التسجيل، يجب الدفع بعد مرور 60 يوماً من تاريخ النشر وإلا اعتبر الطلب متنازل عنه.

وفيما يلي بعض التعليمات لمليء استمارة طلب تسجيل علامة:

§        الاستمارة الواحدة يجب أن تحوي على فئة واحدة فقط.

§        تحدد الفئات من تصنيف نيس للسلع والخدمات (الإصدار رقم 11) بحسب الفئة التي يرغب استخدام العلامة فيها ويمكن الرجوع للموقع التالي لاختيار الفئة المناسبة.

§        ترفق 3 صور من العلامة المطلوب تسجيلها.

§        شهادة تثبت مزاولة المهنة أو النشاط، (مثال: السجل التجاري أو الصناعي أو الإفتراضي — الخ)

§        يرجى الرجوع إلى ما ورد في استمارة الطلب المرفقة لمعرفة المزيد من المتطلبات والمستندات والموضحة بشكل مفصل في الصفحة الأولى للاستمارة.

ثانياً: يفضل قبل تقديم طلب لتسجيل علامة التأكد من أن العلامة المراد تسجيلها وحمايتها:

1.    لم تستخدم في سوق مملكة البحرين من قبل الآخرين.

2.    لم تسجل كسجل تجاري للأفراد والمؤسسات

3.    لم تسجل كعلامة تجارية لدى مكتب العلامات التجارية بمملكة البحرين ويمكن التأكد من ذلك بتقديم طلب الفحص المبدئي عن علامة تجارية ودفع الرسم المخصص البالغ 100 ديناراً واستصدار شهادة رسمية تبين أن العلامة لم تسجل في الفئة المرغوب تسجيلها أو فئات أخرى.

4.    لم تستخدم أو تسجل في الدول التي ترغبون أن تصدروا لها منتجاتكم أو تقدموا فيها خدماتكم (اختياري في حالة رغبتكم لتصدير المنتج خارج مملكة البحرين).

5.    ليست علامة مشهورة.

6.    غير مسجلة كموقع على شبكة الإنترنت (Domain Name).

7.    لا تخالف قانون العلامات المعمول به في مملكة البحرين أو أي قوانين أخرى في مملكة البحرين أو الاتفاقيات ذات العلاقة.

ثالثاً: يمكنكم تقديم طلب للحصول على “شهادة طلب إيداع” لطلبك المودع بالإدارة (حال إيداعه)، وذلك بكتابة خطاب موجه لمكتب العلامات التجارية موضح فيه رقم الطلب واسم الطلب واسم مودع الطلب مع الرسوم المقررة وهي (50 دينار)، وهذه الشهادة تستخدم لتسهيل تسجيلاتكم في دول الخليج العربي والدول الأخرى.

رابعاً: بخصوص تقديم طلبات لتسجيل علامتكم التجارية في دول مجلس التعاون الخليجي، فيمكنكم عند حصولكم على شهادات الإيداع، التعامل مع أحد مكاتب الملكية الصناعية في مملكة البحرين أو أحد المحامين المتخصصين في مجال الملكية الصناعية للقيام بتسجيل علاماتكم في الخارج
